Defending Your Future
When charged with a criminal offence, you need a defence lawyer you can trust to fight for your future.
Areas of Practice
01
Immediate Roadside Sanctions
If your licence has been taken after a shallow impaired driving investigation, I can argue to get your licence back in front of a SafeRoads Alberta Adjudicator.
02
Trafficking and Drug Offences
From simple possession to trafficking drugs, each case requires a careful analysis of the evidence. Importantly, I try to challenge the constitutionality of the police investigation.
03
Sexual Offences
The stakes are high in every sexual offence case. I have experience fighting these cases at trial and making the right applications to better your chances at trial.
04
Property Offences
Whether it is a shoplifting case or a complicated fraud allegation, I will review the case against you and seek out the best possible resolution, whether it is by negotiation or argument.
05
Violent Offences
Violence is treated differently by judges and prosecutors alike, especially in domestic cases. I am confident I can help you deal with the nuance involved and get your life back on track.
06
Youth Crimes
There are unique considerations and procedures that apply to young adults facing criminal charges. I can help you navigate this system and resolve the case favourably.

THOMAS SCHOLTEN
BIOGRAPHY
Before becoming a lawyer, Mr. Scholten apprenticed with experienced defence lawyer, Richard Muenz. Though they operate separate firms, Mr. Scholten continues to work with Mr. Muenz on complex cases.
At Law School, Mr. Scholten volunteered with Student Legal Assistance (“SLA”) and is now a trusted mentor and volunteer lawyer at SLA.
At every step of the process, Mr. Scholten advocates for his clients; before the judge and with the Crown prosecution services. He is not afraid to fight your case at trial or to negotiate ruthlessly with the prosecutor for the best outcome of your court case.

Have Questions?
Frequently Asked
Questions
How expensive is it to hire a lawyer?
Legal fees are not cheap. Thomas Scholten understands this but also knows that it doesn’t have to break the bank. At his firm, clients benefit from affordable legal fees and payment plans.
I have a court date coming up, do I need a lawyer?
While you technically don’t need a lawyer, it is highly recommended that you hire a lawyer. Not only does this mean you don’t have to go to Court as often, your case will progress much more efficiently. Without a lawyer, the criminal justice system can be harsh, complex, and unforgiving. Protect yourself by hiring a knowledgeable defence lawyer.
Will I go to jail if I plead guilty?
Not every criminal offence carries a jail sentence but it will also depend on your circumstances. You should never plead guilty to an offence without first knowing the sentence sought by the prosecution. A good defence lawyer will make sure you get a sentence that accounts for your circumstances and background.
Can the conditions of my release be changed?
The short answer: yes. The long answer? In most circumstances, it will be up to the Crown prosecutor whether your bail conditions can be changed. A good defence lawyer will advocate for better, suitable conditions that fit your situation.
What are my chances of winning my case?
Every case has its strengths and weaknesses but even a good defence can be undone by a poor defence lawyer. Conversely, a weak case may succeed with a when handled by a capable defence lawyer. A defence lawyer can tell you more about what to expect if you go to trial.
